About Us

Johannesburg Metro Chess is the region that represents chess players in the Johannesburg area as part of the Gauteng Province Chess. We are a handful of volunteers who assist clubs and players where possible in organizing tournaments. We strive to enhance the reach of chess within Johannesburg and to enable all to participate in chess at school, regional and national levels.

Hello All

 

The recent announcements by Mr Joe Mahomole and his cohorts refers. 

 

In terms of section 34 of the Constitution of the Republic of South Africa which deals with access to courts in the Republic, everyone has the right to have any dispute that can be resolved by the application of law decided in a fair public hearing of a court or, where appropriate, another independent and impartial tribunal or forum. Both the IEB and Mr. Du Toit and the EXBO inclusive of Gauteng Chess have decided to exercise their respective rights in this regard wheres the hearing of the appeal referred to above is still pending.

 

Since both parties have elected to have access to the courts in terms of section 34 of the Constitution of the Republic by initiating litigation and, more recently, appeal processes respectively in the above regard which are empowered by the strongest law in our country, it follows that any dispute resolution in terms of section 13 of the National Sport and Recreation Act, 1998 (Act No. 110 of 1998 as amended) or any consideration by the newly appointed Minister of Sports, Arts and Culture to intervene in this dispute, will be put on hold subject to the exhaustion of the mentioned appeal process against the previous judgments given thus far which judgment on appeal will be binding on both parties.

 

Mr Mahomole is clearly on a frolic of his own and is trying to divide the chess community by sowing confusion.  Attached is a summary of the events and legal position.  The Chess SA Executive as elected on 8 December 2018 is the legitimate executive of Chess SA for the following reasons:

  1.     The attached  document confirms that the Executive elected on the 8 December 2018 and is currently the law in South Africa;
  2.     The legal department of First National Bank evaluated all legal documents and released the Chess SA bank accounts to the Executive on 8 December 2018.  First National bank would not have done this if they are 100% sure who oversees Chess SA.
  3.     In the urgent application Mr Mahomole brought to the Hight Court of Gauteng he brought it in his personal capacity against Chess SA.  This is a clear acknowledgement by Mr Mahomole that he is not representing Chess SA and it makes it clear that Mr Mahomole has no respect for the laws of South Africaor the Constitution of Chess SA.
  1. We received a letter from SRSA (Department of Sport and Recreation South Africa) to acknowledge the current court cases and that the Executive as elected on 8 December 2018 is the legitimate executive of Chess SA.  We have been invited to a meeting with SRSA on 25 June 2018.  See the attached letter.

 

I want to stress that any announcement made by Mr Mahomole and/or his cohorts are illegal and against the constitution of Chess SA.  Chess SA will, from here on, not hesitate to act against any person who takes part in any way in the activities of Mr Mahomole and his cohorts or the so called “IEB”.  We ask every member of Chess SA to take this warning very seriously.  If you are unsure about the contents of any communication, please feel free to ask for guidance from the secretary of Chess SA.  The official communication from Chess Sa will be through the following channels:

We also understand that the chess community is being put in an impossible situation in deciding who is telling the truth.  It would be naïve of us to expect you to take our word on the current situation.  Every region and province should have an ethics committee or at least a parent who is a lawyer who is on your side and will give you the best advice.  I suggest you consult with a lawyer that you trust and ask his/her opinion.  I have no doubt that they will quickly determine that the board as elected on 8 December 2018 is the custodian of chess at this point.
